About EVV

Effective December 3, 2023, the requirement for electronic visit verification (EVV) transactions, currently used for home and community based services (HCBS), will be extended to include home health care services (HHCS) for home health visits.

Electronic visit verification utilizes mobile-based technology to validate caregiver visits by capturing visit data as required by section 12006 of the 21st Century Cures Act. Once EVV is required for HHCS home health visits, those claims will not be processed without an approved and validated EVV transaction.

The December 3, 2023 implementation date is to ensure compliance in Kansas by the federal deadline of January 1, 2024. 

The State of Kansas will continue to provide an EVV application that will be available to providers and caregivers at no charge.

In addition, the State of Kansas has selected a providers’ choice model whereby providers have the option to use third-party EVV applications, once the application is authorized by the State of Kansas.

The 21st Century Cures Act

Section 12006(c)(2) provides that section 1903(l) cannot be construed to require the use of a particular or uniform EVV system. However, section 1903(l)(5)(A) provides that the system must be able to electronically verify, with respect to visits conducted as part of personal care services or home health care services, the following:

1.) The type of service performed.  
2.) The individual receiving the service.
3.) The date of the service.
4.) The location of service delivery.
5.) The individual providing the service.
6.) The time the service begins and ends.
